Court rejects traders' plea on sealing operations

New Delhi, Sep 8 (IANS) The Supreme Court Friday rejected a petition filed by a traders' body seeking a stay on sealing of illegal commercial premises in residential areas in the capital.

A bench of Chief Justice Y.K. Sabharwal and judge C.K. Thakker told senior counsel Fali S. Nariman, appearing for the Federation of Delhi Traders Association, that prima facie the Delhi Laws (Special Provisions) Act, 2006 was invalid and void and it was not inclined to entertain the petition.

But the association could express its views by pleading as a party to the main petitions coming up for further hearing Sep 12. The association had sought a direction that the act, providing for one-year moratorium on sealing operations, be declared valid.

Regarding the notification issued by urban development ministry Sep 7, permitting mixed land used in several colonies to provide relief to traders facing closure of their shops under the ongoing sealing drive, the bench said it would consider on merits as and when the matter was brought to its notice.
