Mullaiperiyar dam row: Supreme Court notice to Kerala
New Delhi, Sep 8 (IANS) The Supreme Court Friday issued notice to the Kerala government following Tamil Nadu's application seeking a stay on a law enacted by the Kerala assembly restricting the water level of the Mullaiperiyar dam.
A bench of Chief Justice Y.K. Sabharwal and Justice C.K. Thakker issued notice after counsel for Tamil Nadu made a mention about filing of the application in the original suit filed by the state in April for declaring the Kerala Irrigation and Water Conservation (Amendment) Act, 2006, as unconstitutional.
The bench asked Kerala to file its response in a week and directed listing of the matter after two weeks.
The Kerala law was enacted following a judgement of the apex court delivered on Feb 27 asking Kerala to allow Tamil Nadu to raise the water level at the dam from 136 ft to 142 ft after some repairs were carried out.
In its suit, Tamil Nadu maintained that applying the law to the Mullaiperiyar dam, which is under the ownership and control of Tamil Nadu though located in Kerala, was unconstitutional, null and void being as the matter was beyond the competence of the Kerala assembly.
