"Office of Profit" row, HC grants four more weeks time to EC
New Delhi, Sept 13 (ZEENEWS.COM) The Delhi High Court on Tuesday granted four more weeks to the election commission to file its reply as to why it did not forward to the President, the list of 54 MPs who could face disqualification for holding "Office of Profit".
A division bench of acting Chief Justice Vijender Jain and Justice Kailash Ghambir, however, refused to entertain any arguments on the constitutional validity of the recent parliamentary enactment which exempted several posts held by MPs from disqualification; as the matter was already being dealt by the Supreme Court.
Jain, in a PIL had earlier complained that the EC failed to forward its recommendation to the President for disqualification of the 54 MPs though it "selectively" acted in seeking disqualification of then Rajya Sabha member Jaya Bachhan who represented the Samajwadi Party.
However, today when the matter came up for hearing the counsel for the EC said a similar petition on the issue was pending before the Supreme Court.
When Jain who is the managing director of the Jain Televisions tried to make submission about the validity of the recent enactment, the bench asked him to approach the Supreme Court.
But the bench directed the EC to file its reply within four weeks as to why it "failed" to forward to the President its recommendations on the disqualification of 54 MPs who were earlier accused of holding various "Office of Profit" as alleged in the petition.
Earlier, in July the court had granted similar four weeks time to the EC to file its reply on Jain`s allegations.
